Automobile & Truck Collisions

The Johnson Firm and Price Johnson regularly represent individuals who have been involved in serious automobile and truck collisions. When any collision involves a commercial vehicle or tractor-trailer combination, the injuries sustained by our firm's clients are unfortunately very serious. It is our goal to guide our clients through the entire legal process to make certain they recover for their injuries and loss. Keep in mind, even if you do not have an attorney representing you, both the trucking company and the insurance company certainly do. The insurance company is not your friend, and it does not want to pay you anything at all if it can keep from it and it will certainly never pay you any more money than it has to. What's more, the insurance adjuster often has incentive to pay you as little as possible. Having an attorney on your side is the only route to leveling the playing field between you and the insurance company so you can get the fair treatment you deserve.

We have extensive experience in automobile and truck collision lawsuits and claims. We handle many serious cases each year and can help you recover for medical bills, funeral expenses, lost wages, pain and suffering, physical impairment, and various other losses as well. If you have questions concerning an automobile or truck collision, don't wait for answers to your important questions, contact Price Johnson now. For more information on car accidents…

Nursing Home Injuries

When people age they become more vulnerable to abuse, neglect, and exploitation. Some older people opt to move into nursing homes or long term care facilities to ensure that they are well cared for, and will be protected from the effects of their deteriorating physical and/or mental conditions. In these settings, however, older people are sometimes actually physically and/or psychologically harmed by the negligent or intentional acts of their caregivers.

In nursing homes, assisted living centers, and long-term care facilities, several factors often contribute to the abuse or neglect of residents, including: poorly qualified and inadequately trained or supervised staff; staff with a history of violence; inadequate numbers of staff; the isolation of residents; and, the known reluctance of residents to report abuse out of embarrassment or fear.

It is both an honor and a welcome challenge to represent the elderly in personal injury litigation. Specifically, these cases present the challenge of overcoming a tendency on the part of others, including insurance adjusters and even physicians, to discount an elderly person's injuries and the diminished quality of life that results from them. With an attorney's thorough investigation and effective presentation of the losses sustained by an elderly client, however, insurance adjusters and jurors can be convinced to fully compensate injured senior citizens.

Premises Liability

Multimillion dollar jury verdicts against landlords and business operators for failure to provide adequate security and for negligently hiring, training, and supervising employees that endanger the public are becoming more common. Premises liability law is the body of law that makes the owner or tenant of land or premises responsible for certain injuries suffered by persons who are present on the premises. For example, an apartment complex, shopping center, grocery store, business, private home, and almost any other business or private property where a person is. Although some premises cases, such as so-called "slip and fall" cases, can seem simple, in many states, Texas included, the law now very much favors the premises owner and tenant over the individual. Price Johnson has successfully held numerous property owners responsible for neglecting the safety of their guests, tenants, and patrons. See more…

Business Litigation

At The Johnson Firm, we focus on complex, high-stakes litigation, including breach of contract, fraud, intellectual property, trade secret, breach of fiduciary duty, class action, tortious interference, financial services, securities, RICO and other statutory causes of action, and professional liability cases, while representing clients in a broad range of industries, including the energy, oil & gas, telecommunications, real estate, computer, information technology, and consumer products fields. The Firm has the experience and flexibility to provide clients with the highest quality representation, on a creative, cost-efficient basis. With an aggressive, result-oriented attitude, our business litigation attorneys are committed to meeting any client’s business goals.

Just like in any game, the only way to compete effectively in the business world is if the rules are followed by all the players. When your competitors breach contracts, steal technology, misrepresent facts to induce you into deals, infringe upon intellectual property rights, or engage in unfair trade practices, your ability to compete effectively is undermined. Likewise, even if you’ve been playing by the rules, your ability to compete may be hindered by competitors that file unfounded lawsuits and arbitrations against your company. At The Johnson Firm our aggressive business litigation and commercial arbitration attorneys will actively pursue your claims and defend you when your business is unjustly accused of such practices.

Professional Malpractice

Most professions, including law, medicine, architecture, accounting, engineering, pharmacy, and others, are very diligent and aspire to high standards of ethics to ensure that their client or patient is protected at each stage of the process. Unfortunately, not every professional in each profession holds fast to the legal and ethical standards required by their respective profession and their client or patient suffers damages as a result of professional misconduct. While most professionals are ethical and strive to be the best at what they do, there are always bad apples.

If you have been harmed as the result of legal accounting, medical, or other professional malpractice contact The Johnson Firm. We uphold the highest professional standards in our law practice and we have the experience necessary to engage in the complex litigation involved in pursuing a claim for the damages incurred as the result of professional malpractice. Price Johnson is a licensed attorney and Certified Public Accountant and has successfully represented individuals and businesses in professional malpractice claims against the following professions…

Unfair Insurance Practices

If you have filed a claim with your own insurance company and the claim was denied or not paid, then you may have legal recourse to recover benefits due under your policy. Texas Law provides guidelines for an insurance company to follow when handling your case. These include setting forth specific time lines for the insurance company to acknowledge and begin investigating your claim, as well as time lines to make a decision whether your claim is paid or not.

In addition, the law provides that an insurance company must conduct a fair and impartial investigation. Too often this is just not the case. For example, if an insurance company retains an outside consultant to assist with the investigation of a claim, the outside consultant must be fair and impartial in their evaluation. This holds true whether the outside consultant is a pseudo-medical professional reviewing medical records, conducting a medical exam, or if the consultant is an engineer rendering an opinion as to the cause of damage to your property. Insurance companies don't just refuse to pay you’re business, auto, homeowner, and life insurance claims, however, they also refuse to pay the health insurance amounts due to your doctor and other health care providers for the reasonable and necessary medical expenses you incur. Because of that, doctors and hospitals charge ever increasing rates to make up for the services they are never paid for.

Most insurance companies do not live up to their promises and simply do not treat their policyholders fairly. Insurance companies with slogans such as "You are in good hands" and companies claiming to be "Like a good neighbor" do not ring true when the company is clearly looking for a large profit instead of looking out for their customer. Insurance Companies across America refuse legitimate claims and adopt the Deny, Delay, and Defend approach to keep from paying valid insurance claims. Price Johnson worked for an insurance company and knows firsthand how they take your premium payments but then deny your claim. If you believe that you were treated unfairly by your insurance company, Price Johnson may be able to help.

Dangerous Drugs & Pharmaceutical Errors

Pharmaceutical companies are required to put the safety of consumers before profits. Physicians and pharmacists are required to hold to a professional standard of care. When these corporations and professionals fail to uphold their responsibilities and market dangerous or defective prescription drugs patients may be seriously injured or die.

The number of people needlessly hurt or killed by prescription drugs has become astonishing. The FDA and others, including the American Medical Association and the Harvard School of Public Health, have reported that prescription drugs cause an enormous number of preventable injuries and deaths. Preventable injuries result because of anything from a drug reaction, interaction with other drugs, to carelessness in prescribing or filling drugs. Mistakes can occur at any point in the prescription drug delivery process, from the manufacturer all the way to the sales clerk or nurse assistant that actually hands the drug to the patient.

Adverse drug reactions in hospital patients alone account for an estimated 106,000 deaths and 2.2 million injuries each year, according to a study published in the Journal of the American Medical Association. This study did not even include deaths and injuries caused by errors. Another study at the Harvard School of Public Health found that 6.5 percent of the patients at two Boston teaching hospitals had been injured by their medications. One-third of these injuries were the result of a mistake. These numbers alone tell us the number of people unnecessarily killed and injured by prescription drugs has reached epidemic proportions.

Defective Products - Product Liability

Today, corporations continue to develop new products faster than ever before. Corporations want to get the product from the drawing board into the hands of the consumer as fast as possible.  That means taking short cuts and spending less time testing products for safety. "Profits before people." In the end, this means that products often arrive on the market without being thoroughly tested. Many products, including automobiles, seatbelts, air bags, prescription drugs, child "safety" seats, children's toys, children's clothing, infant cribs, industrial equipment, machinery, farm equipment, household products, and many others, make it to store shelves, showroom floors, and the workplace in an unreasonably dangerous and defective condition.

Consumers frequently make assumptions about items they regularly purchase in malls, grocery stores, pharmacies and mail-order catalogues. Naturally, consumers assume that the products they purchase are safe for consumption and free from defects as they should be. Unfortunately, many items consumers encounter and use in their day-to-day lives pose substantial threats to consumers due to design defects, manufacturing defects, other product defects, or side effects of the product.

If you or a loved one have been the victim of a defective product, protect your rights by contacting The Johnson Firm.

Toxic Substances

Exposure to substances such as asbestos, benzene, chemicals, mercury, lead, silicosis, Teflon, solvents, pesticides, MTBE, toluene, xylene or any other toxic substances can cause life threatening and debilitating injuries. Many of these substances are known human carcinogens. When exposure to the substance is because of someone else’s negligence, the victim may be entitled to receive compensation for medical expenses, lost wages, loss of physical capacity, pain, suffering, as well as mental anguish. Injuries can be anything from cancer, mental retardation, birth defects, emotional disorders, thyroid conditions, central nervous system damage, respiratory illnesses, kidney disease, liver dysfunction, blood disorders, and death. Find out the truth behind what happened to you. Call The Johnson Firm now.

Job Site Injuries

Injuries sustained at work have specific requirements before you can recover compensation for your injury. On-the-job injuries arise from many sources, including falls, defective machinery, repetitive movement, negligence of co-workers and third parties. Sub-contractors may also have a claim for injuries sustained while working at their primary workplace or at another job site. Common injuries include back and neck injuries, carpal tunnel syndrome, broken bones, chemical injuries, or burns. You may have claims against your employer if they are not a subscriber to workers' compensation insurance.
